Each Purchase Order placed by buyer for goods and/or services is subject to these standard purchase terms and the terms of the applicable Purchase Order.
The seller reserves the right to cancel the order at any time without notification to the buyer, after which any payment made by the buyer to the Seller will be refunded promptly.
Herein mentioned “Seller” refers to the firm Danaco (SE8507212739) located in Växjö, Sweden. To enter this agreement you need to be at least 18 years of age or have guardians permission.
2. Governing law and jurisdiction
The transactions contemplated by these terms shall be governed by, construed and interpreted in accordance with Swedish and European laws. The United Nations Convention on Contracts for the International Sale of Goods, done in Vienna on April 11, 1980 shall not apply.
Any disputes arising out of or in connection with the Agreement shall be settled through the European Online Dispute Resolution Tool or ultimately brought in the local court of Växjö, Sweden.
3. Prices and payment
Supplier shall deliver the Goods and/or perform the Services against the price(s) mentioned in the Agreement and paid by the Buyer in advance via PayPal. Prices in the shop are presented including 25% VAT, which applies to all customers in the EU. Exports to countries outside the EU are VAT and duty unpaid, which then are solely the buyers responsibility upon receiving the goods and most often to be paid directly to the carrier upon delivery.
Customers within the EU have the right to return unused and undamaged items within 14 days upon receival and get a refund (excluding return shipping). Before returning the goods, you need to contact the Seller at email@example.com and inform of us about your decision.
5. Force Majeure
Supplier will be excused from the obligations of the Agreement to the extent that performance is delayed or prevented by any circumstance beyond its control and unforeseeable at the time of entering into the Agreement, provided that the party claiming Force Majeure immediately notifies the other party with reasonable details including any expected impact and expected duration of the Force Majeure event.
Deliveries are handled by either DHL, UPS or standard postal services and any local customs duty and value added tax are billed to the buyer directly from the freight handler that also manages the customs declaration.
If the package arrives in a damaged state, firstly report to the carrier but please also notice us of the incident by mail to firstname.lastname@example.org
If the Supplier fails to meet its obligations (including its warranty obligations or obligation to deliver in time), or Buyer reasonably believes that Supplier will not meet such obligations (including the event that Supplier becomes insolvent or otherwise unable to pay its debts or is declared bankrupt or ceases doing business as going concern or commences liquidation), then Buyer, without prejudice to any other rights or remedies it may have under the Agreement or at law, shall have the right to terminate the Agreement by written notice to Supplier.
Seller disclaims all liability for damages or injuries, direct or indirect that arise as a result of the use or assembly of our products.
